CON: A Look Ahead

The CON Commission will be reviewing the standards in 2020.

The Certificate of Need Commission will be reviewing the following CON standards in 2021:

  • Bone Marrow Transplantation
  • Heart/Lung and Liver Transplantation
  • MRI
  • Psychiatric Beds and Services 

The Department of Health and Human Services will be accepting feedback on any changes that should be considered to these standards in October of 2020. 

A Standards Advisory Committee (SAC) for Cardiac Catheterization will be considering updates to the standards in response to CMS approving many cardiac cath procedures for payment in ASCs as well as general updates. A SAC will also review the Hospital Bed standards to determine how observation beds should be treated within the standards, and provide clarification in the Limited Access Area provisions and methodology. Workgroups will be reviewing the MRI and PET standards for necessary updates. The Nursing Home SAC will also be reporting their recommendations for updates to the bed need methodology before the end of the year. We also expect recommended changes to the CT and NICU standards from their respective workgroups in 2020.

The Department will be auditing Surgical Services and Air Ambulance for compliance with CON standards in 2020, based on the 2018 CON Annual Survey data.
